Terms of Service

By using Vitola ("the app") you agree to these terms. If you don't agree, don't use the app.

1. Eligibility

Vitola is intended for adults age 17 or older. Cigars are tobacco products and the app discusses them substantively. By using Vitola you represent that you meet the age requirement in your jurisdiction.

2. Subscription

Vitola Premium is an auto-renewable annual subscription priced at $59.99 USD per year (price varies by region per Apple's auto-conversion). Premium unlocks unlimited cigar identifications, your private library and tasting journal, wishlist, and unlimited community reviews.

• Payment is charged to your Apple ID account at purchase confirmation.
• Subscription auto-renews unless cancelled at least 24 hours before the current period ends.
• Renewal is charged within 24 hours of the period's end at the same price (unless we notify you of a change at least 30 days in advance per Apple guidelines).
• You can manage or cancel your subscription in Settings → Apple ID → Subscriptions on your iOS device.
• Deleting the Vitola app does NOT cancel an active subscription. Cancel through the Apple Settings flow above.
• No partial refunds for unused time of a cancelled subscription, except where required by local law.
• There is no free trial.

Apple's Standard EULA governs the app license itself.

3. Free tier

You may use Vitola without subscribing. The free tier includes browsing the cigar catalog (5,800+ entries), reading community reviews, and one (1) Detect identification + one (1) saved cigar in Mine for lifetime. To go further — unlimited Detect, saving more cigars, wishlist, public reviews — Premium is required.

4. Your content

You retain ownership of the tasting notes, ratings, photos, reviews, direct messages, and profile photo you create ("Your Content"). By marking review content public, you grant Vitola a worldwide, royalty-free license to display, store, and distribute it within the app and on the cigar's community review feed. You can revoke this license at any time by editing the session to private or deleting it.

You represent that Your Content:

• Is yours to share (you took the photo, you wrote the note);
• Does not violate third-party rights;
• Does not contain harassment, hate speech, doxxing, sexual content, or content involving minors with tobacco.

Zero tolerance. There is no tolerance for objectionable content or abusive behaviour — in direct messages, community reviews, or profile photos. By sending a message or uploading a profile photo you agree to this policy. Violations remove the content and may terminate your access.

5. Moderation

Community reviews, direct messages, and profile photos can be reported by other users, and any user can be blocked from a profile or a conversation. Reported content enters a moderation queue. Vitola staff review reports and act on objectionable content within 24 hours — hiding or removing the content and, where warranted, banning the responsible account. Repeated violations result in account suspension. We may suspend or terminate accounts that abuse the report system or attempt to manipulate the community.

6. Cigar catalog

Vitola maintains a master catalog of 5,800+ cigars including brand, line, vitola, dimensions, origin, wrapper, and editorial ratings sourced from public publications and curated authenticity guides. Catalog content is provided "as is" — Vitola does not warrant that every detail is accurate, current, or that any specific cigar described is available for sale. The catalog is for informational and identification purposes, not consumption advice.

7. AI identification

Vitola's "Detect" feature uses a vision AI model to match photographed cigars against our catalog. AI predictions are probabilistic — they include a confidence band and may be wrong. You should not rely on Vitola identifications for purchase authentication, legal proceedings, or any decision where mistakes have meaningful consequences. Always verify against the band, packaging, and a trusted retailer.

8. Account deletion

You may delete your account at any time from Settings → Sign in → Delete account. A 30-day reversal window applies — signing in within 30 days restores the account; after 30 days deletion is permanent. Deleting an account does not refund any active subscription period.

9. Warranty disclaimer

Vitola is provided "as is" and "as available". To the maximum extent permitted by law, Truemium OÜ disclaims all warranties express or implied, including fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, Truemium OÜ's total liability arising from your use of Vitola is limited to the amount you paid for the subscription in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

11. Governing law

These terms are governed by the laws of Estonia. Disputes are subject to the courts of Tallinn, Estonia. If you are an EU consumer, you retain any non-waivable rights of your country of residence.

12. Changes

We may update these terms. Material changes are announced in-app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
